How I handled a traffic ticket in the state of CA.
I was traveling on Mission Road in Fallbrook California on
my way to pick up a friend at the bus station.
I had rented a small car but ended up with a red hot PT
cruzer, I was stuck behind this weaving smaller very old smoking Honda
civic.
I had to wait for the rolls can hardly (rolls down a hill
can barely make it up the next) to get to a broken yellow line I could pass
it at. As I went to pass it, it sped
up endangering me because a car had followed me CLOSELY from behind. I was forced to floor it and to pass
it. As I passed it, The sheriff
turned on his emergency lights.
I asked him why he’d pulled me over, he asked me how fast I
was going, I said I was not driving but traveling and who was the damaged
party whom I’d trespassed on. He
informed me I’d gone from 40 (behind the smoking civic.) to 70 miles an
hour. I was passing and I informed
him that I was the injured party and he should have pulled the yellow
smoking civic over for endangering me and him. I then asked him if he had a grand jury indictment
to hold me for questioning, he said no.
I informed him it was 1000 dollars per minute for illegally holding
me without that indictment, to answer any of his questions. His answer was an acceptance for value, “
Yeah, whatever.” It went on that I
was not in the DMV computer and he wanted my Social Security Number, of
which I refused without a warrant. He ran from me when I said that. He handed the ticket to me and demanded I
sign it, which I did not, I wrote “ Refused for fraud it is a writ of attainder.”
Sam Davis and Remedy Community Call http://recordings.talkshoe.com/TC-49164/TS-270995.mp3 We started out from N. CA about 8 pm and
got to San Bruno about 11pm. There was a detour onto 238 and we got lost
for a bit.. I was traveling all night and sometime early in the morning we
had a problem..
In Orange County we hit a big piece of either rubber or
black top. I was behind a car and it I saw it just as it kicked up, I did see
it but only as it came up under us. It looked to be about a foot and a half
long and about 6 inches by about 2 to 3 inches, now remember it was rolling
as it came up under us so I couldn't tell you if it was a rock or rubber. I
didn't see a curve to it so I think it may have been black top. I drove all
night and ended up 5 min late for the opening of the court doors.. They
didn't even notice.. I fretted over it. The Mustang we were driving would
over heat if I went over the speed limit, which instead of having over an
hour to get some coffee, do my makeup (war paint) and straighten myself up
we had to walk in as is. I took a number and waited for it to be called. I
was called up to the clerks counter 4, and I served her with the US
District Court File, She handed me a piece of paper and this little tiny
pink slip which they would not allow me to keep. (the pink one) At 8:30
they called in about 50 people. As I walked through the door I handed the
Bailiff a pink slip. I also informed him he was fired.. WHICH means that he
was acting outside of the bounds of the law! He was not a bailiff anymore
and he was a private person with a gun and a bad attitude.. (acting
criminally!) www.uspinkslip.us I told him flat out that he was fired, and
Alexis and Martha` followed behind me. They called people up to the
"bar" table and proceeded to fine each and every one of them at
least 451 dollars. The poor lady before me had cancer and she'd missed a
court date because she ended up in the ER three times the day of her court
appearance. She didn't look good, she looked like the walking dead, she was
so skinny and in so much pain.. It was simply awful to see her there..
Everyone was called alphabetically, but me. I was the last one called.. I
came up to the bar table and I asked the Judge; Does this court take
Judicial Notice of the State Constitution He answered: Do you mean the
California Constitution? Does the court take Judicial Notice of the Federal
Constitution? He answered: Only as it applies to the Federal Government. I
asked him if he was openly striking against the Constitution in open court
He did not answer. He proceeded to be of bad behavior and talk over the top
of me and asked me if I was pleading ‘Not guilty, Guilty or Nolo
Contendray. Of which I stated that such a request was unconstitutional and
that I was pleading INNOCENT as the question could only be asked is if I
plead Innocent, not innocent or no contest. He ordered his bailiff to haul
me out of court at that moment and I stepped up the microphone and said you
have struck against the constitutional form of government a 1918 crime and
you are a criminal. I asked the Bailiff if he was rushing me to judgment
and I fired him the second I walked through the court doors.
http://www.uspinkslip.us/ IN HOT PINK! I tried to serve the judge the proof
I had removed the case to the US District court and the bailiff said that a
third party had to serve it not me.. The bailiff grabbed me by the wrist
and pushed me out the side door. Martha` came running as fast as her little
disabled body could move and grabbed the papers out of my hand and had
Alexis take the papers to the bailiff, who refused service and the clerks
handed her back the papers.. We had to wait for my name to be called at the
clerks counters, there were 12 counters. I ended up teaching a little bit
of constitution to 4 people. They were shocked to learn that the whole
thing was a sham.. At about 9:00 I was called up to the clerks counter
number 4. Martha` and Alexis followed behind me and the clerk kept shouting
at them that if they had not been called or had a number they couldn’t be
at the clerks counter. Alexis came forward and I introduced her as one of
my 2 process servers, but Martha` was trying to hide behind a pole and I
had to call her to me very quickly. I handed Alexis my papers and looked at
her and said “please serve the court clerk” Alexis handed the paper to the
Court Clerk and the court clerk went back to talk to her supervisor at that
moment.. When the court clerk came back from talking to her supervisor the
clerk tried to get me to sign the document in front of her and except that
the Judge had entered a plea for me. I refused to sign the document as I
had already removed the case to the US District Court and that the judge
had practiced law from the bench and had acted as an attorney, thus
committing a high crime. The court clerk told me we had to take the papers
back to the court and instructed us to go back to the court room. http://www.stoptyranny.us/Sued4pullingMeOver.pdf I held the door open for my process
servers, and Martha` does not move well so it took us a bit to get in.
Martha and Alexis were already seated when I came into the court room.. As
soon as I came into the court room the judge looked like he was going to
pop, he was so red in the face and so angry. He stood up from his seat, and
grabbed his robe and RAN to his little office.. His bailiff looked like I’d
just thrown in a bucket of shit on him.. The clerk came rushing up to me,
as I was sitting next to the aisle and whispered to see her back at the
clerks counter number 4. I got up, and waited for Alexis and Martha to
proceed me. As soon as we were out the doors I moved quickly leaving both
Alexis and Martha to come up behind me, to the Clerks Counter. Alexis and
Martha were in eye shot of me but not ear shot yet. The clerk returned my
paper work even though it had been served by a third party and even though
they had no authority to refuse my paper work. TITLE 28 > PART III >
CHAPTER 41 > § 607. Practice of law prohibited Federal Rules of Civil
Procedure Rule 45. Duties of Clerks The clerk shall enter a record of all
papers filed with the clerk. The clerk tried one last time to get me to
sign her fraudulent document and I refused, she said she’d be sending me my
papers and acknowledged that the US District Court papers did supersede the
lower court. The court clerk after she’d already been served said I had to
go serve it to the clerk’s office in the building next to us. Since I knew
this court I just took my little papers, went over and made more copies of
what she handed me and included the bill and the pink slip and the
“violations cops” with it.. They were making me work, I figured I’d make
them shake.. www.stoptyranny.us/SD-9-23-09.pdf I went over date stamped the documents
put it into the in box of the court clerks. We left the court and went
straight to Walmart where we got radiator fluid, oil, and transmission
fluid. I put the fluids in and we left for Sizzler where we had lunch and
where we also went to the dollar tree. We got on the road about 2:40 pm
when we hit the freeway, and we got to McBride street Exit in LA when the
car broke down. I pushed the car into the side so it would be “parked.” I
was so hot I got something to drink and Alexis went off to find someone to
get to fix the car. Everything was closing up and we didn’t rent a car in
time and we didn’t get a uhaul in time and while I was at it I called TJ to
get help with a local Uhaul and it turned out that he was being held for
his DOJ plate in Roseville and being harassed by the cops there. It was
already 6 something when things really seemed hopeless to me and I feared
we’d have to sleep in the car and figure out how to get home the next day.
We had to be in court in Vacaville at 1:30 pm so that was just not
acceptable. This really nice lady came up to us and her husband owned the
repair shop on the corner. I had Brian and Jaime getting me numbers to the
local Uhaul and then to the Greyhound bus. The next bus out of there was
7:40 and we got a ride from the wife of the mechanic to the Greyhound bus.
We were getting our things out of her little van when two men started
negotiated with Martha` and Alexis to drive us home. The two men had an
extremely nice truck and we all sat in the back seat which didn’t have seat
belts that worked. Honestly since I’d spent all night up driving and then
setting in the hot sun and having pushed the car a block I was rung out to
dry. I went to sleep for a little while and although the conversation was
lively I hardly remember much of it. We stop after Hwy 99 to eat at a In
and Out Burger and to use the rest rooms. I paid my 100 bucks which covered
Alexis and I and Martha paid for gas and food which covered her 50 dollars.
We got into the truck again and I fell very soundly asleep, I think because
of the food. I woke up and we were on the 580 and the driver was swerving
he was so tired.. I started talking to him and woke up the rest of the
group we were about 1 hour away and he was not able to do this on his own
anymore. We came over the bay bridge and it was lit up like a Christmas
tree. I do not think I have ever been so happy to see SF before in my life!
We got to Alexis’s house around 2 am. I grabbed my things and went pee and
to bed and woke up to my alarm at 10 am the next day. I had not slept in so
long and it had been so very stressful. On Oct. 5th the document will
default for the 46,060,000.00 million I put the bill in for..
It is high time that the Government fears the people so we
may have JUSTICE! Thomas Jefferson: When governments fear people, there is
liberty. When the people fear the government, there is tyranny. Our
petitions have been slighted; our remonstrances have produced additional
violence and insult; Shall we gather strength by irresolution and inaction?
Shall we acquire the means of effectual resistance, by lying supinely on
our backs, and hugging the delusive phantom of hope, until our enemies
shall have bound us hand and foot? Patrick Henry - March 23, 1775 When will
we be willing to stand against the tyranny of no representation? Acting
